Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the sidecode.co.uk website or the Sidecode mobile application (together, or individually, the "Service") operated by Sidecode ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
[SEC-1.0] ACCOUNTS AND REGISTRATION
1.1 Accuracy of Information. When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
1.2 Account Security. You are entirely responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
1.3 Device Limits and Account Sharing. Sidecode accounts are strictly for individual use. Account sharing is strictly prohibited. Sidecode employs security systems that prevent simultaneous account usage across multiple devices to protect the integrity of your learning progress and prevent subscription abuse. If simultaneous sessions are detected, earlier sessions will be automatically paused, logged out, or permanently flagged for manual review.
[SEC-2.0] SUBSCRIPTIONS, PURCHASES & BILLING
2.1 Subscription Plans. Some parts of the Service are billed on a subscription basis ("Sidecode Plus"). You will be billed in advance on a recurring and periodic basis (such as Monthly or Annually). At the end of each period, your Subscription will automatically renew under the exact same conditions unless you cancel it or Sidecode cancels it.
2.2 One-Time Payments. Alternatively, limited-time lifetime access deals or specific virtual goods (such as Gems or Lootboxes) may be offered as a one-time payment. Virtual goods hold no real-world monetary value and cannot be exchanged for fiat currency.
2.3 Billing Information. All payments are processed securely through accredited third-party payment gateways (Stripe, Apple App Store, or Google Play Billing). You shall provide Sidecode or our third-party payment processors with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information.
2.4 Fee Changes. Sidecode, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will not affect your active, existing subscription period, but will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in fees.
[SEC-3.0] REFUND POLICY & CHARGEBACKS
3.1 Conditional 14-Day Guarantee. Sidecode provides a highly technical, digital education service. Our 14-day money-back guarantee is strictly conditional. Refunds will ONLY be issued in the event that the service provided fundamentally deviates from the descriptions presented prior to purchase, or in the event of severe, continuous technical failure that prevents access to the core curriculum. This is not a "no-questions-asked" or "try-it-and-see" policy. Changing your mind, lacking the time to code, or finding the material too difficult does not qualify for a refund.
3.2 Exclusions. One-time payments for virtual currency (Gems), cosmetic items, Lootboxes, or lifetime deals are strictly non-refundable under any circumstances once the digital goods have been credited to your account.
3.3 ZERO TOLERANCE CHARGEBACK POLICY. We take payment fraud and disputes extremely seriously. Any attempt to initiate a chargeback, payment dispute, or forced reversal through your bank, credit card issuer, or PayPal will result in the immediate, permanent, and irrevocable termination of your Sidecode account. In the event of a chargeback, all account progress, collected XP, leaderboard standings, and virtual items will be permanently deleted, and your IP address and device ID will be blacklisted from creating future accounts. If you have an issue with a billing error, you must contact our support team directly to resolve it.
[SEC-4.0] ACCEPTABLE USE & GAMIFICATION
4.1 Platform Integrity. Sidecode provides competitive leaderboards, arenas, and virtual currency systems. To maintain a fair environment for all learners, you agree that you will NOT:
- Use automated scripts, macros, auto-clickers, or botnet software to farm XP, automatically complete lessons, or artificially manipulate the Leaderboard.
- Attempt to reverse-engineer, decompile, exploit, or hack the Sidecode application programming interface (API), database structures, or matchmaking servers.
- Exploit any bugs or glitches in the platform to gain an unfair advantage over other users.
- Submit abusive, inappropriate, sexually explicit, or intentionally malicious code (including prompt injection attempts) to the AI Tutor framework.
4.2 Enforcement. Violation of any of the rules outlined in Section 4.1 will result in the immediate and permanent banning of your account without warning. Any subscription time, XP, or virtual currency forfeited due to a ban is strictly non-refundable.
[SEC-5.0] INTELLECTUAL PROPERTY
5.1 Sidecode Property. The Service and its original content (excluding code written by users), features, curriculum structure, artwork, mascots, branding, audio files, and platform architecture are and will remain the exclusive property of Sidecode and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Sidecode.
5.2 User Property. You retain full ownership and intellectual property rights of any raw code, algorithms, or projects you independently write within the Sidecode Sandbox or code editors. You are free to use your personal projects for portfolios, commercial use, open-source repositories, or any other legal purpose.
[SEC-6.0] LIMITATION OF LIABILITY & DISCLAIMERS
6.1 "AS IS" Basis. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
6.2 Educational Outcomes. Sidecode is an educational tool. We make no representations, warranties, or guarantees regarding your future employment, interview performance, salary, or career outcomes. Completing the Sidecode curriculum does not guarantee you will pass a technical interview or be hired as a software engineer.
6.3 Liability Cap. In no event shall Sidecode, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content. In no event shall our total liability to you exceed the amount you have paid to us in the last six (6) months.
[SEC-7.0] INDEMNIFICATION
You agree to defend, indemnify and hold harmless Sidecode and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
[SEC-8.0] TERMINATION
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service or request account deletion via the platform settings. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
[SEC-9.0] GOVERNING LAW & DISPUTE RESOLUTION
9.1 Jurisdiction. These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
9.2 Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
[SEC-10.0] CHANGES TO TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
